The Constitutional Court of South Africa on Thursday dismissed Afrikaans lobby group AfriForum's application for leave to appeal previous rulings which found that EFF president Julius Malema's "Kill the Boer" chant did not constitute hate speech.

In 2022, the Equality Court ruled that the anti-apartheid chant couldn't be considered hate speech and that its lyrics could not be interpreted literally, a ruling upheld by the Supreme Court of Appeal in 2024.

The order on Thursday stated: "The Constitutional Court has considered the application for leave to appeal. It has concluded that the application should be dismissed as it bears no reasonable prospects of success. Leave to appeal is refused."
