A judge in the Eastern Cape High Court in Gqeberha on Wednesday questioned the intentions behind the city manager's failure to give two councillors, including the mayor, time to respond to their "expulsion" from the National Alliance (NA).
The mayor, Gary van Niekerk, approached the court last week for an interdict to stop the Independent Electoral Commission (IEC) from declaring his seat and that of fellow NA councillor, John Mitchell, vacant.
The city manager, Noxolo Nqwazi, wrote a letter to the IEC earlier this month to inform them of Van Niekerk and Mitchell's "vacant" seats.
